Got Stay Order for Minimum Wages

 

We, KPHA, got the stay order for minimum wages ffrom the honourable High Court

We hope you are aware about the introduction of Wage Protection System (WPS) through newly introduced software by which Govt. can collect even minute details of our institutions and this software can deduct the staff salary directly from our account without our concern .Now the Labour Department is going to implement this in all districts.

 

Hereby, we would like to inform you all our members that we need not to join in WPS as it is stayed by the Hon: Kerala High Court in Writ petition No. WP(C) 18055/2016 (F) filed by KPHA by challenging the amendments of minimum wages rules. The court stated that the stay shall be for the members of the association only as in the list filed along with writ petition.

 

The details will be available from our headquarters (9048126123, Mr. Arun Das, Office Secretary).

We congratulate all the members of KPHA who are in the track to protect our legal rights.

Stay order for WPS-KPHA news.

Dear Members,

Greetings from KPHA

Hon: Kerala High Court stayed WPS (Wage Protection System) in a Writ petition filed by KPHA by challenging the amendments of minimum wages rules. The court stated that the stay shall be for the members of the association only as in the list filed along with writ petition.

The details will be informed once the document is available from the Court. We congratulate state president and state secretary of KPHA for the landmark achievement.

I request all the members who have not paid membership fees and legal fund during the year 2015-2016 and the current year should be remitted immediately to the state treasurer.

Sir/Madam,

As you know, the Labour Department has initiated steps to implement an electronic salary transfer system (WPS) by amending the minimum wages Act, that seeks to ensure wage protection in Private Hospitals, among other sectors in the State.

Under the proposed system, payment of salary in private institutions will be made mandatory through bank accounts and introduced an online monitoring mechanism to ensure the same. Employers will have to furnish the details of their institutions and employees through a software maintained by the Labour commissionerate.

In this situation, KPHA decided to convene a meeting of all the Private Hospitals in Ernakulum district on 10th May 2016 at 3.30PM at Hotel the Woods Manor, MG Road, Kochi,Ernakulam South, Ernakulam – 682011.

You may be aware that, the Union Government of India has initiated Key Labour Legislations  by introducing four draft bills namely Labour Code on Industrial Relations Bill, 2015; Labour Code on Wages  bill,2015; Labour Code on Social Security And Welfare Bill, 2015; Labour Code on Safety And Working Conditions Bill, 2015. On going through the draft bills it is seen that the proposals are not at all establishment friendly. The stringent provisions contained in the Chapter 5B of the Industrial Disputes Act are going to be made applicable to other establishments like shops, commercial establishments. hospitals etc. Once that proposal is brought out then the establishments will have to comply with the harsh conditions that 3 months notice and prior permission from the Government for effecting the retrenchment of an employee, lay off, closure etc. The punishment even for a minor lapse is proposed upto 10 lakhs in the first instance and 20 lakhs for the subsequent offence besides mandatory imprisonment  upto 6 months. The proposals are really alarming.

 

The Govt of Kerala has also recently brought out  drastic changes in the Kerala Shops & Commercial Establishment, Rules 1961 -

 

  • To have separate toilets for men and women employees even in a small establishment
  • Separate toilets in the ratio of one toilet for every 20 employees.
  • Rest Rooms having a package of amenities including toilets in the said ratio. 
  • If the number of female employees is more than 19, crush with a package of amenities including a duly qualified aaya. 
  • Hostel facilities for those coming from beyond 25 km  distance. 
  • Penal provisions are  made stringent. 

 

 In the Kerala Minimum Wages Rules , 1958 -

 

  • To upload the details of employees in Form XXIV ( 44 columns) every month.
  • To disburse salary only through Banks to each employee’s account.

 

Payment of Gratuity Act-

 

The notification which makes mandatory that the establishments should have  tie up with insurance companies for gratuity payment will also result in heavy financial burdens to the establishments.

 

Industrial Establishments Standing Orders Act-

 

As per the amendment now it is mandatory for hospitals with more than 50 employees to  get Standing orders certified by the labour Dept.

 

Taking into account the seriousness of the Labour Law scenario Forum For Reforms In Corporate Laws (FRICL) and All Kerala Private Hospital Association jointly  conduct an updation programme on 27th November , 2015 at Hotel Das Continental, Thrissur from 4.30 pm to 6.30 pm. The gathering is also meant to deliberate the ways and means to prevail over the situation.

 

This programme is arranged exclusively for the key personnel of the organisations. Managing Directors, Directors, Partners, Entrepreneurs and CEO are only expected to participate in the programme.

The proposed Clinical Establishment Bill-2013 to be presented soon in the assembly is a very dangerous law against private sector hospitals of small to medium size.


In this Bill government defined minimum standards to be set up in various grades of hospitals, divided the hospitals into Level-1,Level-2,Level-3 etc., proposed very huge penalties to the hospitals ranging from Ten thousand to Five Lakhs rupees and even rupees Ten Thousand per day for violation of the rules.


For the doctors and staff working in this hospitals also have to pay fine of Rs.25,000/-.

 Dear Sir/Madam,

 Almost an year has gone peacefully in the field of health care. The Industrial Relations Committee (Health Sector) constituted by the government of Kerala by a Gazetted notification with equal number of representatives from management side and employees to discuss and find solutions for the issues in the field. As you know the burning problem in that time was the strike by Nurses demanding higher pay. Government had appointed a commission headed by Dr.Balaraman has chairman and two others (Both from Nursing field) to study the problems of Nurses working in private sector in Kerala. Unfortunately some of the associations wanted to get in to the commission as a part. But KPHA stood firm and declared that this commission is not acceptable to us as they are biased. As we expected the commission instead of studying and reporting the prevailing situation they came up with suggestion for hike in the salary structure starting from Rupees 12,900/-.

The honorable minister of labor declared in the Kerala Legislative Assembly that the recommendation will be implemented with effect from June 2012. Request and continuous pressure by KPHA supported by the managements the Hon: Minster agreed to implement the decision of IRC keeping away the Balaraman Commission recommendations. And in April 2013 a unanimous decision was reached in the IRC and decided to pay higher rate of salary with effect from January-2013. Taking in to consideration the burden on paying arrears from January 2013 the committee had agreed to pay the arrears in small installments till December 31, 2013.Though the government orders came late has the suggestions of IRC were to be confirmed by Minimum Wages Board which in term asked for opinions from all the corners. It is learned many of the Hospitals have not yet paid the hike and the arrears. KPHA had signed the agreement reached in IRC and still stand on the same decision of the hike recommended. KPHA request all its members to follow the order brought out by the government. It is not a decent act to go to the courts of law and challenge the orders issued after all have agreed as done by one association in the field.

Another important decision taken by the IRC is regarding the training. Even the trade union leaders in the IRC add supported our demand for a practical training of the Nurses in their career of first year. The GO brought out by the government on the recommendation of IRC states that one year(365 days) training to the fresh hands be parted paying a stipend of Rs.6000/- for general Nurses and Rs.6500/- for B.Sc. Nurses. The order is given in the website. Please note the management is bound to issue orders to the trainees noting the date of completion of their training period and ordering them to quit the service in the hospital on the day of completion. They may be served with the certificate of completion of training and conduct. Please note at present strikes are going on in few of the hospitals demanding continuation of service as staff Nurse from the very next day of completion of the training. If the hospital is in need of Nurses the trained hands can be appointed after conducting written examination, interview whatever the management decides. Those who are appointed should be served with appointment order with all conditions as per the decision of the management.
